1. LIABILITY

1.1 As Action Tags Limited has no control over the final use of any goods supplied, it does not accept any responsibility or liability for use or misuse of the goods. The goods are to be used by the Customer in compliance with current organisation standards, codes of practice, and guidelines (if any) specified by the Department of Labour. Where the Customer acquires, or holds itself out as acquiring the goods for the purposes of a business, the Consumer Guarantees Act 1993 shall have no application to any part of the contract whatsoever, and the following provisions shall apply in relation to Action Tags Limited's liability under the contract.

1.2 Subject to the provisions of clause 11.1 hereof:

1.2.1 The liability of Action Tags Limited whether in contract or in tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect or non-compliance of the materials and/or services supplied is limited to replacement or repair of such defective or non-complying materials.

1.2.2 Action Tags Limited shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever.

1.3 No claim by the Customer either for damages or for repudiation of any contract for supply or otherwise shall be effective or enforceable unless made in writing and received by Action Tags Limited within 1 month after delivery of the goods to the Customer (which period the Customer considers to be more than a reasonable time). The Customer shall not be entitled to withhold any payment or to make any deduction therefrom for any reason whatsoever.

2. ACTION TAGS LIMITED'S PROPRIETARY RIGHTS

2.1 All designs, drawings, plans, computations, specifications and other similar information prepared or made by Action Tags Limited shall remain the property of the Action Tags Limited and shall not copied or used without Action Tags Limited's prior written consent. All copyright in respect to same belongs to Action Tags Limited.
2.2 The cards and any other goods supplied by Action Tags Limited are to be used in conjunction with Action Tags Limited holders and covers and shall not be used in conjunction with any other product or for any purpose other than in use with scaffolding and related construction works.
